Terms and Conditions for Shisha Hire

1. General Terms

  • a. By hiring shisha products from Express Hookah PTY LTD (“we”, “us”, “our”), you (“the client”, “you”) agree to the terms and conditions set forth herein.
  • b. These terms are legally binding and apply to all shisha equipment hired through Express Hookah PTY LTD.

 

2. Client Responsibilities

  • a. The client is responsible for the correct and safe use of all shisha equipment provided.
  • b. The client must ensure that the equipment is used in accordance with the guidelines provided by Express Hookah PTY LTD and only by individuals who are 18 years of age or older.
  • c. It is the client’s responsibility to supervise the use of the equipment at all times during the hire period.

 

3. No Liability for Injury or Damage

  • a. Express Hookah PTY LTD will not be liable for any injury, damage, or loss incurred during the use of our shisha products, regardless of the cause.
  • b. The client acknowledges that the use of shisha products carries inherent risks, including, but not limited to, fire, burns, inhalation of smoke, and allergic reactions.
  • c. The client assumes full responsibility for any damage or injury caused to themselves, other individuals, or property while using the hired shisha equipment.

 

4. Indemnity

  • a. The client agrees to indemnify and hold Express Hookah PTY LTD harmless from any claims, damages, liabilities, and expenses arising out of or related to the use of the shisha equipment hired.
  • b. This includes any legal fees incurred by Express Hookah PTY LTD as a result of defending claims related to the use of our products.

 

5. Damages to Equipment

  • a. The client is responsible for any loss or damage to the shisha equipment during the hire period.
  • b. Express Hookah PTY LTD reserves the right to charge the client for any repairs or replacement costs associated with the damage or loss of our equipment.

 

6. Health and Safety

  • a. The client must ensure that the shisha equipment is used in a safe environment and away from flammable materials.
  • b. The client acknowledges that shisha smoking is hazardous to health and assumes all associated risks.
  • c. The client is advised to keep all shisha equipment away from children and pets.

 

7. Termination of Hire

  • a. Express Hookah PTY LTD reserves the right to terminate the hire agreement at any time if we deem the equipment is being used unsafely or if these terms and conditions are violated.
  • b. Upon termination, the client must return all equipment immediately and cover any associated costs for damage or loss.

 

8. Governing Law

  • a. These terms and conditions are governed by the laws of Sydney/Australia. Any disputes arising out of these terms shall be resolved under the jurisdiction of Sydney/Australia.

 

9. Acceptance of Terms

  • a. By hiring our shisha equipment, you acknowledge that you have read, understood, and agree to these terms and conditions.
  • b. Failure to comply with these terms may result in legal action and/or penalties.
